Croatia files motion with ECJ regarding Slovenia’s lawsuit

Pursuant to the government’s decision of 20 December, Croatia today filed a motion with the European Court of Justice in regard to Slovenia’s lawsuit over Croatia’s alleged breaching of the EU law

Pursuant to the government’s decision of 20 December, Croatia today filed a motion with the European Court of Justice in regard to Slovenia’s lawsuit over Croatia’s alleged breaching of the EU law by failing to honour and apply a border arbitration ruling, saying that the ECJ is not competent for settling the dispute.

Croatia is asking the ECJ to dismiss Slovenia’s lawsuit as inadmissible, since the ECJ is not competent to decide on Slovenia’s demands in proceedings envisaged under Article 259 of the Treaty on the Functioning of the European Union given that the dispute between Croatia and Slovenia should be settled by applying international law and that the settlement of the dispute does not depend on the application of the EU law or its interpretation.
