CJEU ruling in Milivojević case

The Court of Justice of the EU on Thursday ruled in the case C-630/17 Anica Milivojević/Raiffeisenbank that Croatia’s legislation on retroactive invalidation of credit agreements concluded with foreign lenders not authorised to provide credit services in that member state is against the EU law

The Court of Justice of the EU on Thursday ruled in the case C-630/17 Anica Milivojević/Raiffeisenbank that Croatia’s legislation on retroactive invalidation of credit agreements concluded with foreign lenders not authorised to provide credit services in that member state is against the EU law.

The CJEU are binding for all member states of the EU, their state administration bodies and their national courts, and they should comply with them. Consequently, the relevant ministries are going to analyse in detail all the arguments of the ruling and consider appropriate action.
