On Wednesday 9 September 2020, the General Court of the European Union in Luxembourg rejected Slovenia’s lawsuit against the European Commission, filed in odrer to revoke the European Commission’s Delegated Act (EU) 2017/1353 of 19 May 2017, which allowed the use of the label "Hrvatska Istra - teran" (Croatian Istria - Teran) on wines produced in Istria.
The General Court confirmed the validity of the Delegated Act (EU) 2017/1353 and its alignment with the aquis, leaving it in effect. This decision underlines the right of Croatian winemakers stipulated in the Act, whose adoption righted the injustice done after Croatia had joined the EU, when Slovenia disputed the use of the “teran” label.
Croatia joined the proceedings on the side of the EC, which had requested of the General Court to reject Slovenia’s suit, presenting the legal, economic and historical reasons Croatian winemakers have the right to use “teran” as a variety.
